Well, the 109th congress already passed part-I of the whole process: changing the US laws to allow special exception for India.
Once the President signs this, they have to negotiate the so called "123 agreement" that is a bilateral *binding* agreement between US and India. It will again have to be approved by congress.
I don't think anyone here knows how long will it take for the "123 agreement" to be concluded and presented to congress for approval. But once it does, expect desi resources on capitol hill to be again busy with it as their top priority. And that would shut us out for the period this stuff is pending in congress.
So what I am saying is that the window between now and when the "123 agreement" shows up in congress for approval is important and we should not miss it. At the very least we should be aware that this is coming and plan accordingly.

I agree with the other post.
You need to make a visit to the nearest uscis office tomorrow morning and give them the details and preferably get that second AP application withdrawn or cancelled or whatever.
Now did you receive just the approval notice for the first AP or did you actually get the AP document? Make sure you got the actual AP document (the one with the photo, etc.).

Is that normal to have the same I-94 number on my renewed H1B and my wife's H4 approval notices?

Hi everyone!
On May 29, 2009, I filed a Form I-485 to get my wife's (from Japan) green-card. On August 11, 2009 it was denied because I had "failed to submit all tax documentation". On August 25, 2009 I filed a Form I-290B which is a motion to reopen and reconsider my case. I included all the additional tax information which they asked for so that I my I-485 would be complete. Finally, today March 6, 2010 I received a notice in the mail saying that my I-290B Form was denied simply because accidentally signed one area of the form where my wife should have signed. What am I supposed to do from here? I had a lot of people recommend that I contact my Commissioner... does he have any power to help me with that? Any help would be appreciated!!

Hello Guys,
I have been working with my current employer for last 3 years as Software engineer and filed for PERM last October (18th Oct 2007). My six year H1-B limit expires in January 2010.
Now I'm getting an opportunity to move into Technical Program Management internally (within the same company).
I have couple of questions based on the above scenario
1. Is it safe to take the new opportunity since I have to start over my PERM process (given the backlog in Atlanta center) and also given the amount of time left in my H1-B (approx 15 months left)?
2. If I file a new PERM application now, can I use the experience that I gained in this company as part of the app OR should I use only my previous employer's experience (which was 3-4 years ago and has little relation with what I might do in program management) for the PERM app?
Your replies are greatly appreicated and thanks for your time

Simple answer is there is no such thing as a temprorary EAD. There used to be but they were eliminated some years ago.
You will just have to wait and hope. If however, the processing time exceeds 90 days you can take an infopass appointment and the local office will contact the service center to get things rolling.

I applied my I-140 in february, 2007. In their system it's showing that it'd been received in FEb 8, 2007. and the case is still pending. As a EB3 from bangladesh when can i expect the approval. Lots of applications those were sent after mine have already been approved. I didn't receive any RFE or anything till now. Can anyone please help me with the update....
